Who We Are and What This Is
PixelBot is built and operated by PixelBay Agency - a UK-based web design and development studio trading under that name. We're not a registered limited company, just real people doing real work. By engaging us to install PixelBot on your website, you're agreeing to these terms.
These terms cover the installation, configuration and ongoing use of PixelBot software on your website. They don't cover any other services we might separately provide (web design, hosting, etc.), which would have their own agreements.
What We Deliver
When you engage us for PixelBot, here's what we commit to:
- Installing PixelBot on your server - either the WordPress MU plugin or the standalone PHP version, as agreed.
- Configuring it to your site - sitemap setup, system prompt, branding, curated links and security configuration.
- Testing it thoroughly before handover - real questions, multiple devices, edge cases.
- Handing it over with guidance on managing it going forward.
Any add-ons (prompt engineering, WooCommerce setup, ongoing maintenance, etc.) are agreed separately and delivered as specified at the time of engagement.
Your Licence
When we install PixelBot on your site, you receive a single-use, non-transferable, perpetual licence to run that version of PixelBot on that one website.
That means:
- You can run it on the agreed website indefinitely - no monthly fees, no subscription, no renewal.
- You cannot install it on additional websites without purchasing a separate installation.
- You cannot share, redistribute, resell or sublicense the software to anyone else.
- You cannot reverse-engineer, decompile or create derivative works from it.
The software remains the intellectual property of PixelBay Agency at all times. You're paying for the installation, configuration and licence to use it - not for ownership of the code.
Your Responsibilities
To keep PixelBot running well, a few things are on you:
- Keeping your hosting environment up to date - a server running unsupported PHP versions or outdated WordPress installations may eventually cause issues.
- Maintaining your Google AI API key - if it expires, hits limits or is deleted, PixelBot will stop responding until it's fixed.
- Keeping your sitemap up to date - PixelBot only knows what's in your sitemap. Old content in, old answers out.
- Not using PixelBot to deliberately mislead your visitors or for any unlawful purpose.
The "Years Later" Clause
Technology moves fast. PixelBot works brilliantly today - it's built on Google's Gemini AI, standard PHP and your existing sitemap. These are solid foundations right now.
But we can't guarantee it'll work indefinitely. If Google changes their API in a breaking way, if PHP evolves past the point of compatibility, or if the web itself looks completely different in ten years - that's outside our control and not something we can be held responsible for.
Your licence is perpetual, but we don't offer indefinite free support or updates. If something breaks years down the line due to platform changes beyond our control, we'd be happy to look at updating it for you - but that would be a new piece of work, not a warranty claim.
If it breaks within a reasonable period after installation due to something in our delivery, we'll fix it. That's just fair.
Limitation of Liability
PixelBot is an AI-powered tool. Whilst we configure it carefully to answer only from your site content, AI responses can occasionally be imperfect. We're not liable for the accuracy of individual responses your visitors receive, or for any decisions made based on them.
We're not liable for:
- Loss of revenue, data or business opportunities arising from PixelBot being unavailable.
- Google's AI API being unavailable, rate-limited or changed.
- Issues caused by changes to your hosting environment, WordPress version or PHP version after installation.
- Any consequential, indirect or special damages of any kind.
Our total liability to you in any circumstances is limited to the amount you paid us for the relevant installation.
Payment
Payment terms are agreed at the time of engagement. We typically require payment before or on delivery, unless otherwise agreed in writing. We reserve the right to remove PixelBot from your server if agreed payment is not received - that's not something we've ever had to do, but it's good to be clear.
Cancellation and Refunds
Once we've installed and configured PixelBot on your server, the work is done. We don't offer refunds on completed installations, but we'll always try to resolve any genuine issues with the delivery first.
If you engage us and then change your mind before we begin work, let us know promptly and we'll discuss it fairly.
Governing Law
These terms are governed by the laws of England and Wales. Any disputes that can't be resolved between us directly would be subject to the exclusive jurisdiction of the courts of England and Wales. We'd always rather resolve things with a conversation first - legal proceedings are the very last resort.
Changes to These Terms
We may update these terms from time to time. The version that applies to your installation is the one in effect at the time you engaged us, not any later version. We'll update the date at the top of this page when changes are made.
